As a matter of international law, the real sticking point is using force on another country's sovereign territory without its consent. The US has advanced a disputed claim that when a country is unwilling or unable to suppress a terrorist threat emanating from its soil it is allowed by international law as a matter of self-defense. This policy again passes over without discussion whether or not that's legitimate or the fact that some people dispute it.
