The director of IT is going to testify that DiAlavera said Trump said delete the server. So it didn't come directly out of Trump's mouth. It's hearsay. How can it be admissible against Donald Trump at trial? Friends here's the beauty of co-conspirator statements. Because conspiracies are especially dangerous and because it's a bunch of people banding together and agreeing to commit crime together, guess what? Every statement made by every co- Conspirator is admissible against every other co-Conspirator. Put another way. You can just assume that it came out of everybody's mouth because everybody in the conspiracy is on the hook.
