The Court's Decision in the Case of the Census Bureau and the Secretary of Commerce
We prevailed on an argument that we were very uneasy about actually making, but that it seemed possibly provocative. And whether or not the government could put such a question on the Census form, they couldn't do it and lie about why they were doing it under the Administrative Procedure Act. The court following a theme here is not much moved, I think, to try to resolve technical disputes.
