In 17 87, there was no federal judiciary in existence at the time. The principal concern was protecting the judiciary from being subsumed by the seemingly more powerful executive and legislatove branches. Much of hamilton madison's efforts were dedicated to explaining how framers had created an independent judiciary. Robert yates wrote a series of essays under the name brutus ad that became known as the anti federalist papers.
