The private key is just non-scareous information, but it's used to control the scarce resource called UTXOs. So you can't have one without the other. It fits into the existing legal system. But that is very difficult or different from the opinions of legal courts in the incumbent world. Like that's, I don't think it's a solved problem, actually.
