Is the Supreme Court Going to Intervene?
Judge Sutterby in his third opinion had halted enforcement of 12 of the provisions of the New York law. The Second Circuit granted that emergency stay, but plaintiffs were unsatisfied with it and appealed to the Supreme Court. "It would have been quite unusual at this point in the case of procedural history for the Supreme Court to have intervened," says Julian Zelizer.
