The Federalist Society's project to refute the claim that this is a race blind enterprise. The only explicit reference to race in the Constitution is in the 15th amendment, which prohibits racial discrimination and voting. Congress has the right to enact laws to justify the contours of what rights should be protected. And I'm glad that Justice Jackson made that point.
