The state has been taking cases where water protectors have allegedly trespassed on construction sites. A gross misdemeanor trespass is the difference between 90 days in jail and a thousand dollars, or up to one year in jail and three thousand dollar fine. It all comes down to statutory interpretation. The legislature wrote this to apply to active pipe lines, not to pipe lines that are under construction. And they're using very, a very particular section in the state's theft statute that applies to indifference to the owner's rights.
