What Is the Other Side Like?
The Supreme Court is a very radical court right now, and has been for a while. The initial originalists were tied to this idea of judicial restraint. They believed that if there wasn't a clear conflict between a law and the constitution, it should not be struck down. As conservatives have gained power over the course of the subsequent 50 years, they have sort of quietly abandoned that right.
