Kagan Voted to Deny the Petition to Stay the Texas Law
Kagan voted to deny the application. She has said in previous petitions like this that she just doesn't see a line of consistency on likelihood of success on the merit on irreparable injury, those two sort of standing out the most. A duly enacted government policy is the status quo. And so when you're talking about returning to status quoa, that would in some ways set out more of a standard.
