David Bianculli: This is one of the more exciting cases of the term. He asks, do you think true threats should be whether a reasonable person would think they were being threatened or whether the person who's making the statements had some intentionality? John L. Wood: I feel like it's hard as a general matter, this idea that intent is less relevant than impact. But in this circumstance, how a reasonable person perceives this seems to be really truly aimed at what prohibiting true threats is about. And then listeners think through this through and then we'll read the communications.
