Open source code is a very good model to valuet these things with. It's just not something that you should be upset about a human doing having learned it from your code. Jan, i think some of the confusion around this comes from misunderstanding the difference between copyright and patent. If you're going to do a clean room implementation that's not tainted by the way the other person did it, you don't want to read that code.
