The Purpose of Advisory Opinions
Marco Dappell: There's obviously some other motivation behind these advisory requests. They're not supposed to be solving a bilateral dispute, he says. But in quite a few cases, as Dappell was saying, they are about resolving a dispute or trying to push a dispute forward. The biggest risk when litigants are considering whether to put forward such a request for an advisory opinion is whether it might do more harm than good, the judge adds.
