Is There a Compelling Governmental Interest in Preventing Domestic Violence?
CNN's John Sutter looks at how a layers of scrutiny test would apply to the second amendment case. The government wins if it applies rational basis review, which wasn't an option when the Supreme Court was deciding potential levels of scrutiny for cases. There is a compelling governmental interest in protecting women and children from domestic violence that meets this prong: least restrictive means. If you're meeting that test versus if you had a blanket gun ban, domestic violence is a problem; let's say all husbands must be strict of weapons.
