Our current approach to punishment rests on a bedrock of personal volition and blame. Blameworthiness should be removed from the way we talk about things in the legal system, he says. But instead of debating culpability, I suggest our effort should be to focus on what to do moving forward with an accused lawbreaker. How is this person likely to behave in the future? Are criminal actions likely to be repeated? Can this person be helped towards pro-social behavior? How can incentives be realistically structured to deter crime?
