In 1861, when the British took over rule of India, that is when the law was codified and drafted to make homosexuality a crime. Hindu mythology is very, very open when it comes to sexuality. Even for the many hundred years of Mughal, Muslim rule in India, erotic, homo-erotic poetry, same sex, love, none of it was criminalized. A ruling could come as early as this summer or this fall.
