"This is an example of why it's important for Congress to be a functioning body that actually passes laws and addresses some of these issues proactively," he says. "The court can only do so much in terms of like coming up with alternative frameworks that make more sense ... And that's a job for the legislature at some point, but I don't know when they're going to get around to actually taking action on this."
