The Court of Appeal Ruled That the Claimant Could Not Rely on the Evidence of Dr Gibson
It was acknowledged that on behalf of the claimant that it was inappropriate for the claimant's solicitor's to have provided comments solely to Dr Gibson and Dr Gibson shouldn't have responded. It was wrong for an expert solicited input from their own solicitor during the process of drawing up a joint statement and perhaps even more wrong for the solicitor's to provide that input. The rules make it perfectly clear it is the expert who must give their opinions as paragraph nine seven of the practice direction of CPR thirty five makes clear experts must give their own opinions in this way.
