The Taxpayer Standing in the Affordable Care Act Case

The student loan program is retroactive, meaning as college students graduate now, they're still going to want to go work at a nonprofit because the forgiveness program will still be in effect. And so on the one hand, it says that doesn't preclude standing just because this all depends on the actions of third parties, but it's a much higher burden. They're going to have to bring actual evidence that this will prevent people from coming to work for them. Otherwise, it could very well be tossed out on mere speculation problem.
