I used to be a lawyer so I think that it is about assessing how the worst case scenario of X plays out and avoiding it. Some of the best lawyers I've seen have stood up and caught and you've gone god that's a mad argument they're never going to win with that but then they do. So many people who work in politics know Politics 101, which is literally politics 101. They are just applying that tactic to the nth degree.
