The European Court of Human Rights Bill - Quatification of Damages
The bill makes some significant amendment to the quatification of damages. It requires courts to take into account a number of factors both when deciding whether to award damages at all and, if it does so, decide in deciding their amount. In doing that, it seems to be seeking to strike a balance between redress and the public purse more generally. The need for such a balance was high lighted as long ago as two thousand and three by lord wolfe in the anifuges of rigeva and london borough of southwalk case.
