The Court's Fear of Prosecution

In 1975, in a case called Hicks v. Miranda, the court held that federal claims must be dismissed even if the state criminal charges are brought after the federal case is filed. "You can sort of quickly see the doctrine being taken to absurd places," he says. The decision effectively gives police departments a veto power over federal court claims against them.
