The Past Isn't Dead, It's Not Even Past
The case was good law up until a few years ago, and we'll talk about that in a little bit. The pattern it evances is pretty consistent, I think throughout American history, of the courts giving broad deference to the executive to run rough over the Constitution. So yeah, this case, the past isn't dead, it's not even past, right? That's what this case feels like reading it to me.
