The Supreme Court and the Constitution
There's no mention in the Constitution of the Supreme Court knocking down laws based on constitutionality. Congress should pass a law to regulate the court, writes Cosey. In Belgium, France, and Italy, for their Supreme Courts to make a decisionbased on constitutionality, the decision must be unanimous. And in Germany and Spain, the court does that, not by law, but by tradition.
