Brooke's preffertory material to Romeo's and Juliet is all moralistic, largely anti-Catholic. Shakespeare may have taken the idea of having an argument and outline from Brooke but he changes the motivation for this tragedy quite distinctly. The fatal law here is not just one of genre in general but of the source in particular.
