The Major Questions Doctrine

The major questions doctrine is a response to Chevron deference, which has been the dominant mode of judicial interpretation of agency action for 30 plus years. It means in practice that the court will strike down agency actions that conservatives don't like. John Roberts and Sam Alito must now decide whether or not these cases should be decided on this basis.
