Is the Judge Discretionary?
Why was so much time and money expended on the case before the section 33 of the limitation act? Discretion question was considered. In most cases, the question of when to hear the issue of whether or not extend time is dealt with at a relatively early stage in the proceedings. The judge held that it would be better to hear all the facts in the case so that he could better determine what evidence there actually was and wasn't.
