The Left's Argument for the Supreme Court to Be Political
The framers of our constitutional order intended for the court to be categorically less political than the other two branches of government. Dettodiah Britain Purdy writes, quote, like it or not, the courts are another political branch. Most of all, when they decide basic constitutional questions, such as whether freedom and equality forbid extreme gerrymandering. Later in the article, he addresses Roe, writing, quote, since the US Supreme Court overturned Roe v Wade in 2022, many liberals have rediscovered a democratic insight.
