This is one of those first amendment cases that just turns into a strange bedfellows mishmash. The ACLU and the electronic frontier foundation and the reporter's committee for freedom of the press all lining up with that we need the specific intent test. And on the other side, you have joined others, including another friend of the show, Professor Danielle Citron, arguing that no online harassment is really different. It cannot be regulated under a specific intent standard because looking only to what the speaker thinks will allow stalking and harassment to proliferate.
