How to Determine a Sentence in Federal Criminal Cases
Sentences in federal criminal cases are governed by sentencing guidelines. In 2005, the Supreme Court said that it was really unconstitutional to have them be mandatory. Nevertheless, the judges do go through the process. Most January 6th defendants had effectively no prior criminal record.
