The Importance of Retained Rights in Court

When Americans write their constitutions, they are very enthusiastic about protecting rights. But when judges have protected unenumerated rights under state constitutions, it's a lot of the same story as what's happened at the federal level with the US Supreme Court. Some rights have been protected at times, but often they have cowed how to what the state or local governments want to do.
