The Debate Between Justice Brown Jackson and Justice Thomas on Systemic Racism
The debate we're seeing now is moving beyond the affirmative action, which is where the modern left is wanting to go. The point of it is that systemic racism empowers states to take into account disparate impacts on race. This may be a legislative matter in some circumstances, but for justices, they're not doing sociological experiments about broad categories of classes and races and tasks.
