Polycentricity - The Defining Characteristic of a Polycentric Issue
Polycentricity is a feature of our world and especially of the legal world. It gives courts a certain unease, I think about scrutinizing government policy too closely. Parliaments recast very complicated policy issues in terms that suits its decision making process. Governments do the same thing - Executive bodies, environmental regulatory organizations all do this. And it doesn't really make the argument out that we should be particularly worried about courts.
