Jefferson's Decision to Not Deliver the Commission
In Marbury versus Madison, Chief Justice Marshall said that all that were necessary for testing a federal judge was to name the person in the Senate who should give its advice and consent. In America, state courts can hear any kind of case, but a federal court can only hear certain kinds of cases. The question whether Marbury had a right to be a JP and DC didn't matter to anybody, really.
