The Selective Prosecution Claim in the January 6 Assault on a Capital
Once it becomes a crime, it's no longer protected by the First Amendment. It would have raised big issues that would have at least rhetorically been used to say, this is selective prosecution. And they just avoided all that by going with charges that are either bread and butter or have been routinely charged in the January 6 case themselves.
