S5E6 - Constructive Dismissal (with Marc Jones)

Employment Law Matters

CHAPTER

The Last Straw Can Be an Ass

Employer can't stop employee claiming constructive dismissal by apologising or paying the shortfall of wages. Mark Jones: 'To me, that sounds tremendously unfair' The last straw doesn't have to be a breach of contract in itself. It has to amount to something, but it can't be trivial. But if somebody resigns in part because they haven't been paid properly and in part because their spouse wants to move to a different part of the country, does this mean an employee cannot claim constructive dismissal?
