More than 70 million Americans work as independent contractors. 30 percent of those freelancers chose to leave a full time job for the express purpose of being able to work independently. States can proactively protect independent contract status by codifying that sort of common law test, the common sense test is how I like to call it for freelancing. If the pro act becomes federal law, everything you love about independent status ceases to exist.
