The Commerce Clause in the Constitution
Congress shall have the power to regulate commerce between foreign nations among the several states and with the Indian tribes. It was effectively a direct response to some of the problems with the Articles of Confederation which was too loose. Had that clause not been put in the Constitution I think it would have been inevitable that you would have had tariffs interstate. The United States is an internal free market machine and Congress is going to enforce that.
