Is It an Institutionalist Concern or a Conservative Justice?
Conservative institutionalism would be a conservative justice who is taking into account, sort of the institution of the court. For instance, should change be incremental rather than revolutionary? That's an institutional type concern. And so it can be whether justices from lower courts are going to have an easy time following that precedent.
