I Think the Jury Was Simply Wrong on the Malice
I think the jury was simply wrong on that, and maybe they would have been reversed had that been an explicit ground. They were arguably right on the malice, although i think it's a closer case because the times mistakes always tend to favor the left. I like judge rakoff. I think he made a mistake here. He could have written the decision, put it in a drawe and then released it as soon as the jury verdict came out. It's almost impossible that the jurors wouldn't learn about his actions. And then he might have thought, g i'm not that important. Even if the jurors learned that, i would dismiss it. That's too risky.
