Justice Sotomayor wrote that the legal duty of a business open to the public is to serve the public without unjust discrimination. She says, yet for as long as public accommodations laws have been around, businesses have sought exemptions from them. Backlashes to race and sex equality gave rise to legal claims of rights to discriminate, including claims based on First Amendment freedoms of expression and association. This isn't new, it's just the first time this court has given quarter to these arguments.
