Benjamin Tucker is a 19th century publisher and journalist. He was one of the first libertarians that I encountered who had this picture of patents as state created privilege rather than a legitimate protection for ideas. The courts try to say in principle that laws of nature facts of nature are not patentable as inventions but it's coming increasingly difficult because we're obviously getting into some kind of scary dangerous territory where we could potentially be infringing intellectual property rights.
