In Scotland, the independent prosecutor is the procurator Fiskel. John Fisher detained William Burke and others for questioning. He would then go to the Fiskel with what information he had. The Fiskel would petition the sheriff for a warrant for further questioning. A handwritten document dated 3 November 1828 tells you something troubling that may come to dog this whole story. It's almost as if the person least considered in all this legal flourish is the victim, the old woman in a box.
