What Is Testimonial Immunity?
The doctrine comes from a hypothetical memo that william renquest wrote when he was asked about sapinas, which were congress compelling testimony of presidential advisers. He said there are certain advisers who are so close to the president, who help the president on a data day basis, that they don't have to show up at all in response to a congressional sapina. It is just an absolute, a doctrine that says, i will not come and give testimony, even if privilege wouldn't apply. The trump administration asserted it multiple times, including the impeachment inquiry. And it basely cuts off all avenues of congressional inquiry into the testimony of senior, senior advisers.
