Matt Levine: Musk wanted to buy Twitter in April, but now it was May and he had moved on to other Japs and frolics. The market for social media stocks had fallen even further; the price of Tesla stock, which Musk was relying on to pay for Twitter, was also weighed down. He says there could be shenanigans in this situation - they could end the trial with Twitter effectively saying that Elon's word is good enough for them...and then he could turn around and terminate it again. Levine: It seems likely that Elon thought that he was unlikely to be able to win this battle in court. And so there might be even less distracting to just do the deal the way
