A Case Involving a General Dental Surgeon and an Expert Witness
The underlying claim is that of Robinson and Liverpool University NHS Foundation Trust which subsequently became a wasted costs application. The trust relied entirely for breach of duty and causation evidence on the evidence of an expert called Mr Mercia who was a general dental surgeon. He had no experience of surgical removal of teeth under General Anesthetic since 2000 when he'd served in the armed forces. A sum of just over fifty thousand five hundred pounds was awarded against Mr Mercia. This is a very stark example again of someone getting it wrong but one does come across experts who are almost suitable but not quite.
