The M F N Most Favored Nation Anti-Competitive Clause

The DOJ brought a case in Michigan about this. The department and the state of Michigan alleged that the M F N clauses in Blue Cross Blue Shield of Michigan's contract with hospitals decreased competition amongst health plans. Some clauses required hospitals to charge competitors more than the hospitals charged BC BSM, often by a specified percentage. Employers are unaware a lot of times of how they are being charged more than what might be appropriate.
