The State Constitution for the Open Fields Doctrine
In places where there's migratory birds, an interpretationof the state constitution for the open fields doctrine. Is it going to impact Fish and wild life service enforcement officers ability to investigate offences? And and they would be operating under the open field doctrine established by the united states constitution. So now that doesn't to your deer hanging in a tree thing, in every tree example. But for things where there is some concurrent jurisdiction over species management, like migratory birds,. which are obviously covered by the migratory bird treaty act, a federal authority. This is where it gets confusing for me, and where i think it adds another layer of complexity.
