Osmond and Article 8 possibly Article 3 play a role in the case. The common law should not develop in conjunction with the human rights act, says Lord Toulson. Some people would certainly disagree with it potentially quite strongly. But it does show that this case is very unusual and it does create a massive change in the common law, I'd suggest.
