In 1988, the Sixth Circuit basically said that there is, quote, no such thing as valid jury nullification. In 1997, the Second Circuit Court ruled that if there is evidence of this kind of behavior, a juror can in fact be removed. Experts continue to debate about how often this sort of stuff actually occurs. How often do criminals just get away? Yeah. Where did the judge get paid? We know this occurs, but we debate about how many times it occurs. And the public increasingly believes that in some cases the system is broken.
